Your lawyer for ski and alpine accidents

Ski and alpine accidents are complex and emotional. One lawyer you know, from the first question to the courtroom. Strong practical background (former ski instructor, mountain rescuer and dog handler).

In larger cases, the work is handled as a team (lawyer, trainee lawyer, legal assistant). Court hearings and negotiations always remain a matter for the lead lawyer.

Alpaca and llama walks at mountain resorts combine animal contact, guiding and alpine terrain. If a kick, bite, fall or panic occurs, animal keeper role, guide duties and personal responsibility must be separated.

The case differs from grazing cattle on an alpine path. Here, contact with the animal is part of an organised offer.

From a legal perspective, section 1320 ABGB, instruction, animal selection, lead rope, group size, children, photos, witnesses and medical records matter.

Overview of all answers.

01

Check animal keeper liability

Section 1320 ABGB may matter if an animal injures someone. The key question is who was the keeper and whether keeping, selection and guiding were sufficient.

Next step: document animal, keeper, guide and sequence.

02

Check guide and terrain

For guided offers, route, pace, distance, lead handling, weather and participant information matter. Section 1299 ABGB may be relevant for professional guiding.

Next step: secure route, group and instruction.

03

Assess children and group

With children, age, accompanying adults, group size and clear rules for animal contact matter. Parent information can be relevant but does not replace safe organisation.

Next step: organise registration, age information and photos.

Why organised animal contact is different

During an alpaca or llama walk, contact with the animal is deliberately sold. That can create protective and information duties.

The assessment starts with section 1320 ABGB. Sections 1295, 1299 and, for assistants, 1313a ABGB may also matter. The alpine aspect belongs to touring and alpine route law.

Animal selection, guiding and participant information

Not every unexpected animal reaction can be controlled. Still, animal selection, lead handling, distance, route and information must fit the target group.

With children, anxious participants or narrow paths, the requirements for explanation and group guidance increase.

Which documents help after the incident

Secure photos of the animal, lead rope, path, group and injury. Booking documents, terms, guide and keeper names and medical records are also important.

Later statements by the organiser about the animal behaviour should also be recorded in writing.

Scope: This article covers organised alpaca and llama walks. Grazing cattle on alpine paths, dogs in gondolas and general summer hikes remain separate articles.
