Avalanche airbag, beacon, probe and shovel are safety equipment, not a guarantee of rescue. If a device fails in an emergency, the first distinction is user error, missing instruction, maintenance defect, product defect or chance.

With rented equipment, duties of the rental provider and instruction duties become important. A defect may also raise product liability and warranty issues. Injured persons and relatives should ensure that the device is not returned, repaired or discarded too quickly.

Review rental documents and instruction

For rented devices, the key issue is what was agreed, checked and explained. Preserve contract, handover note, serial number, battery status and staff information. The provider is not automatically liable, but poor maintenance or missing instruction may matter.

Preserve proof of product defect

A technical defect must be shown in a traceable way. Serial number, condition, batteries, cartridge, service history and expert inspection are important. Without the device, proof becomes difficult.

Separate use and maintenance

Not every failure is a product or rental fault. Wrong mode, empty batteries, missing cartridge or no group check may be relevant. First reconstruct who performed which test and when.

Rental, instruction and maintenance

Anyone renting out avalanche equipment must hand over a functioning device and explain recognisable risks appropriately. This does not mean that every avalanche accident is attributed to the rental provider. Handover, maintenance, battery status, visible inspection and concrete instruction matter.

For professional providers, section 1299 ABGB may set a higher standard because expertise is expected. Contract, warranty and product liability may also be relevant if a product defect is alleged.

Preserve device, serial number and test data

The most important evidence is the unchanged device. Returning an airbag, beacon or cartridge too quickly may create proof problems. Photograph serial number, condition, displays, batteries and accessories before anything is changed.

Group members matter too. Who performed the partner check? Was a beacon test carried out before the tour? Was there real instruction or only a quick handover? These questions often matter more than general comments on avalanche conditions.

Liability is not a guarantee of rescue

Alpine safety equipment reduces risks but does not eliminate them. Liability requires breach of duty, damage, causation and fault or a special product liability basis. Tour decisions may also create contributory negligence under section 1304 ABGB.

Relatives should avoid premature accusations and first preserve evidence. A calm technical and legal review separates enforceable claims from tragic but legally non-attributable events.

Do not return a suspect device without review. Serial number, batteries, cartridge, packing state and service history may later be decisive.

What role does product liability play? +

If the product is defective, product liability may provide a separate basis for a claim. The defect and the damage must be proven traceably.

Can my own conduct reduce the claim? +
