After refurbishing an existing cableway, a separate permit question arises: can the permit to put the installation into operation be combined with the construction approval, or must the cableway undertaking apply for an operating permit separately? Sections 46 and 47 of the Austrian Cableways Act 2003 set out these two routes.

Section 46 allows, for an existing cableway, the construction approval to be combined with the permit to put the subject matter into operation, covering the infrastructure, subsystems or safety components named in the application. The condition is that there are no concerns from the standpoint of the safety and order of cableway operations and cableway traffic.

If an operating permit has not been granted under section 46, section 47 requires the cableway undertaking to apply to the authority and state the completion status and the measures still to be carried out. A completion notice is therefore a status statement in the application, not a substitute for the permit.

01 Question 1

Does the project concern an existing cableway or a new construction?

Section 46 of the Austrian Cableways Act 2003 expressly ties its combination rule to an existing cableway.

All paths at a glance

Overview of all answers.

01

The combination rule in section 46 is not designed for a new construction.

Section 46 of the Austrian Cableways Act 2003 starts from the condition that the project is not the new construction of a cableway. The combination of construction approval and an operating permit described there must therefore not be treated as a shortcut for a new build.

The applicable approval route for the specific new construction must be identified separately. This article addresses the permit situation after refurbishing an existing installation.

02

The case falls within the combination rule in section 46 if there are no safety or order concerns.

For an existing cableway, the construction approval can also include the permit to put the subject matter into operation. The provision refers to the infrastructure, subsystems or safety components covered by the application. Section 46 requires that there be no concerns from the standpoint of the safety and order of cableway operations and cableway traffic.

The combination must therefore be read against the actual refurbishment scope and the safety situation. A completion status by itself is not an operating permit.

03

Where section 46 has not granted an operating permit, the section 47 application should state the completion status and outstanding measures.

In this situation, section 47 of the Austrian Cableways Act 2003 requires the cableway undertaking to apply to the authority for the operating permit. The application must state the completion status and the measures still to be carried out.

The description should make the completed parts, the remaining work and the affected infrastructure understandable. This article does not replace an assessment of the specific technical records or the individual case.

04

The application lacks a reliable description of the completion status.

The information under section 47 is intended to show the authority the condition of the installation and the measures that remain. If this status has not been reliably established, the application is difficult to assess on a sound basis.

Complete the technical file first. Outstanding safety-related points must be identified clearly and assessed separately before the installation is put back into operation.

Operating permit after refurbishment: where does the assessment start?

The first step is to define the project. Sections 46 and 47 of the Austrian Cableways Act 2003 concern the operating permit in the context of an existing cableway. The refurbishment may affect the entire installation, individual subsystems or safety components. The application must therefore identify which part of the installation is covered.

The next question is whether the permit to put the installation into operation was already combined with the construction approval. If so, the statutory mechanism in section 46 is relevant. If it has not been granted, section 47 sets the next step: the cableway undertaking must apply to the authority and state the completion status and the measures still to be carried out.

The two provisions form a sequence. The possible combination under section 46 comes first. Where that permit has not been granted, the section 47 application and its status statements must be assessed.

Section 46 of the Cableways Act: combining the permits

For an existing cableway, section 46 of the Austrian Cableways Act 2003 makes it possible to combine the construction approval with the permit to put the subject matter into operation. The statutory text refers to the infrastructure, subsystems and safety components covered by the application. The permit can therefore be linked to the specific refurbishment subject matter.

The decisive limit is the safety and order assessment. A combination is available only where there are no concerns from the standpoint of the safety and order of cableway operations and cableway traffic. The refurbishment scope must therefore correspond to the condition of the installation and the safety-related findings.

The project file should clearly show which parts were refurbished, which parts are intended to be put into operation and what the construction approval covers. A general statement that the refurbishment is complete does not yet establish this allocation.

Section 47 of the Cableways Act: completion status and outstanding measures

Section 47 of the Austrian Cableways Act 2003 applies where an operating permit has not already been granted under section 46. The cableway undertaking must apply to the authority for the permit. The application must state the completion status and the measures still to be carried out.

The completion status describes the current condition of the installation. The measures still to be carried out describe the outstanding side of that status. Both details belong together: an application that lists completed work while leaving outstanding measures unaddressed does not fully present the statutory starting point.

The statement must be kept separate from the permit decision. It shows what the authority is being asked to assess. The mere status statement does not determine whether the operating permit will be granted or which concrete conditions may apply.

Two statutory routes

Keep construction approval, operating permit and status separate.

This allocation prevents the completion status from being mistaken for an operating permit that has already been granted.

Which permit route fits the refurbishment?
Starting point Statutory approach Central information
Existing cableway, permit combined with construction approval Section 46: the construction approval may include the permit to put the subject matter into operation. No concerns from the standpoint of the safety and order of cableway operations and cableway traffic.
No operating permit granted under section 46 Section 47: the cableway undertaking applies to the authority. Completion status and measures still to be carried out.
New construction of a cableway Section 46 expressly excludes this situation from its combination rule. Treat new construction and refurbishment as separate legal and technical projects.

This table is an initial orientation under sections 46 and 47 of the Austrian Cableways Act 2003. The specific refurbishment and technical records remain decisive.

Safety and order concerns before putting the installation into operation

The safety clause in section 46 is the central filter for combining the construction approval and the operating permit. The Act refers to the safety and order of cableway operations and cableway traffic. The assessment must therefore address the specific refurbishment and its effect on the installation.

Outstanding measures must be stated expressly under section 47. This creates transparency for the further assessment. An outstanding measure may have a technical, organisational or documentary character. The statutory text does not create a blanket permission to operate despite every outstanding measure.

Before putting the installation back into operation, the operator should therefore bring together the current condition, outstanding work and the safety relevance of each open point. Where the allocation is unclear, the permit status cannot be determined reliably from isolated records.

Keep new construction and refurbishment separate

Section 46 of the Austrian Cableways Act 2003 starts by stating that the project must not be the new construction of a cableway. The provision therefore expressly limits its combination rule to a different project setting.

The actual project subject matter matters in practice. If an existing installation is changed, the application should identify the affected parts and the refurbishment scope. If a cableway is being built for the first time, the assessment must not be reduced to the refurbishment logic created by section 46.

The distinction should be recorded early in the project file. This prevents an unsuitable legal basis from being carried into applications, internal approvals or communications about the planned operation.

Organise the application records around the actual installation

Section 47 supplies two clear status fields: the completion status and the measures still to be carried out. For preparation, the technical file should allocate each affected subsystem and safety component to the refurbishment scope.

The completed version of the file should separate finished work from outstanding measures. It should also show which installation component each point concerns and whether the point matters for the safety and order assessment. This structure makes the statutory statement understandable.

The sections discussed here do not by themselves establish an additional statutory form or a specific deadline. The concrete application, the competent authority and the complete technical records remain decisive.

Important before putting the installation back into operation: The completion status is a statement in the application under section 47. It describes the current condition of the installation. The operating permit must be treated as a separate legal step. The official texts of section 46 of the Cableways Act 2003 and section 47 of the Cableways Act 2003 are available in the Austrian Legal Information System.

Frequently asked questions

Cableway refurbishment and operating permits.

Does a completion notice replace the operating permit? +

No. Section 47 requires the completion status and measures still to be carried out to be stated in the application where no operating permit has already been granted under section 46. The status statement and the permit must be kept separate.

Can the operating permit be combined with the construction approval? +

That may be possible for an existing cableway under section 46. The provision refers to the infrastructure, subsystems and safety components covered by the application. There must be no concerns from the standpoint of the safety and order of cableway operations and cableway traffic.

What must an application under section 47 state? +

Under the statutory text addressed here, the application must state the completion status and the measures still to be carried out. The specific application requires an assessment linked to the refurbishment and the affected installation.

Does section 46 also apply to a new construction? +

Section 46 expressly requires that the project not be the new construction of a cableway. Its combination rule is therefore directed at an existing cableway and its refurbishment. A new build must be assessed separately.

May an installation operate despite outstanding measures? +

Section 47 first requires outstanding measures to be stated in the application. Whether operation is permitted depends on the specific operating permit, the condition of the installation and the safety assessment. A general permission cannot be inferred from the mere disclosure of open points.
