Your lawyer for ski and alpine accidents

Ski and alpine accidents are complex and emotional. One lawyer you know, from the first question to the courtroom. Strong practical background (former ski instructor, mountain rescuer and dog handler).

In larger cases, the work is handled as a team (lawyer, trainee lawyer, legal assistant). Court hearings and negotiations always remain a matter for the lead lawyer.

During cattle drives, animals, drovers, visitors and trails meet in a confined space. If a fall or animal contact occurs, ordinary pasture encounter is not the only yardstick.

Animal keeper liability, organiser role, temporary closure, visitor guidance and visible personal conduct matter. The review depends strongly on the concrete sequence.

From a legal perspective, announcement, closure, drover instructions, photos, witnesses, injury and route guidance are particularly important.

Overview of all answers.

01

Check animal keeper liability

For injuries caused by animals, section 1320 ABGB is central. Keeping, guidance, drover instruction and controllability of the animal must be reviewed.

Next step: identify keeper.

02

Check closure

In organised cattle drives, closure, alternative route, warning and timing matter. Path keeper issues under section 1319a ABGB may also be relevant.

Next step: photograph closure.

03

Assess contributory fault

Anyone ignoring clear closures or instructions may face contributory fault under section 1304 ABGB. That does not automatically exclude review of operator or keeper liability.

Next step: document notices.

An active cattle drive is more than grazing cattle

With grazing cattle, conduct of hikers and animal keepers on the alpine trail is often central. A cattle drive adds an organised, time-limited risk situation.

The general alpine framework is ski touring and alpine touring law. The existing article on cows and grazing cattle remains relevant for ordinary encounters on alpine paths.

Closure, drovers, organiser and path keeper

The more the cattle drive is announced or touristically accompanied, the more important clear closure, alternative route and visible drover instructions become.

Besides section 1320 ABGB, section 1295 ABGB and, for paths, section 1319a ABGB may matter. The key issue remains who could control which risk.

Which proof matters after a fall or shove

Secure photos of animal, path, closure, drovers, warning signs and injury. Announcement, time, witnesses, rescue report and medical records are also important.

If an organiser or mountain lift guides visitors to the event, advertising text, programme and visitor guidance should also be secured.

Scope: This article covers active cattle drives with drovers, visitor guidance and temporary closure. Ordinary encounters with grazing cattle on alpine paths remain a separate article.
