Rental contract, maintenance and product liability

The rental shop must hand over a roadworthy bike and explain the essential functions. With e-bikes, brakes, support modes, battery and permitted use are not minor details.

With a technical defect, the Product Liability Act may matter alongside contract and section 1295 ABGB. The decisive issue is whether there was a product defect, maintenance error or pure use error.

Brake failure, battery problem and missing instruction

Brake failure is often noticed only on a steep section. Bike number, service history and earlier complaints are then important.

If instruction on support modes or walk assist is missing, the handover itself may be defective. A wrong trail recommendation may add negligent advice.

Insurance and evidence after the e-bike fall

Secure rental contract, photos of the bike, handover record, app data and staff names. Do not report the defect only orally.
