Pulk with child on the piste: liability and limits

Your lawyer for ski and alpine accidents

Ski and alpine accidents are complex and emotional. One lawyer you know, from the first question to the courtroom. Strong practical background (former ski instructor, mountain rescuer and dog handler).

In larger cases, the work is handled as a team (lawyer, trainee lawyer, legal assistant). Court hearings and negotiations always remain a matter for the lead lawyer.

A pulk is a sled towed behind a skier. It often carries a small child.

On ski pistes the pulk raises questions of admissibility and liability. FIS rules apply by analogy.

Overview of all answers.

01

Third party collision

Report to your insurer. We assess liability and contributory negligence.

02

Fall with pulk

Secure medical files. We assess accident insurance and piste claims.

03

House rules breached

A breach of house rules increases the skier liability. We assess negligence and insurance.

Admissibility and FIS analogy

Pulks are not banned in general. House rules of individual ski areas may limit them.

FIS rules apply by analogy. The pulk skier bears responsibility like any skier.

Liability on collision

On collision the pulk skier is liable for own and pulk behaviour. Private liability insurance usually covers this.

Contributory negligence arises with excessive speed. Insufficient securing of the child also counts.

Immediate steps:

  • Photograph the scene and secure witnesses
  • Inform insurer and counsel at once
  • Check house rules of the ski area
Frequently asked

Pulk and piste

Is the pulk allowed on the piste? +

In principle yes, unless the house rules say otherwise. A notice at the lift shop is helpful.

Who is liable on collision? +

The pulk skier is liable like any skier. Private liability insurance usually carries the loss.

What about speed? +

Speed must match the pulk. Too fast triggers contributory negligence.

Is the child insured? +

Personal injuries of the child are covered by accident insurance. Damage to third parties is covered by parental liability.
