Slope rescuers must transport injured persons quickly and safely. At the same time, an akia or rescue sled may move on an open or partly secured slope. If it collides with skiers, a separate liability issue arises.

This differs from delayed rescue and from accidents involving snowmobiles or grooming machines. The focus is securing the area, visibility, line choice, speed and the reaction of other slope users.

The legal framework includes damages under section 1295 ABGB, contributory negligence under section 1304 ABGB and evidence on medical treatment and pain and suffering.

Review visibility and securing measures

If the akia was barely visible or the rescue area was not secured, a breach of duty may be considered. Terrain, sightline, warning post, line choice and speed of the rescue team matter.

Securing the area during rescue

A rescue operation is not ordinary skiing. Patrollers must act quickly and protect the injured person. Still, the deployment area must be secured appropriately depending on terrain and visibility.

Whether warning staff, signs or a closure were required depends on crest, narrow passage, traffic, visibility and speed. There is no simple rule. The concrete slope section is decisive.

FIS rules and conduct of other skiers

Other skiers must pay attention to persons and obstacles on the slope. Excessive speed or ignoring warning signs can create significant contributory negligence, especially if the rescue was recognisable.

Conversely, the mere fact of rescue does not automatically excuse everything. If the sled came unexpectedly over a crest or crossed the line without securing, responsibility may shift.

Which evidence matters immediately

Rescue report, time, position, weather, visibility, witnesses and photos of the deployment area are central. The transport device, team members and warnings should also be documented.

For injuries, medical records, pain, healing process and lost earnings may matter. The collision during rescue must be separated from the original injury.
