Your lawyer for ski and alpine accidents

Ski and alpine accidents are complex and emotional. One lawyer you know, from the first question to the courtroom. Strong practical background (former ski instructor, mountain rescuer and dog handler).

In larger cases, the work is handled as a team (lawyer, trainee lawyer, legal assistant). Court hearings and negotiations always remain a matter for the lead lawyer.

After the death of the other skier before proceedings begin, damages claims arising from a slope collision may still be pursued. The next steps are determined by the stage of the Austrian estate proceedings, the heirs' liability, and possible insurance coverage. A person is not made liable merely by being related to the deceased.

Treatment costs, pain and suffering, and long-term lost earnings are often involved in serious injuries. Before proceedings are brought, the correct defendant and measures to preserve limitation periods must be identified. This article concerns a collision in Austria with another private winter sports participant.

01 Question 1

Which document do you already have?

All paths at a glance

All answers at a glance.

01

Assess a claim against the estate

The case reference, proof of representation, and collision records must be organised. The claim against the estate must be assessed, and the running limitation period must be preserved independently of the end of the estate proceedings.

02

Clarify estate representation

The identity of those who can effectively represent the estate must be established. Where suitable representation is absent, an application for a curator may be appropriate, and the deadline for proceedings requires separate assessment.

03

Identify heirs and liability limits

The court transfer order, inheritance shares, and declarations accepting the inheritance must be provided. These documents identify the proper defendants and liability limits, and insurance cover is examined additionally.

04

Locate the estate proceedings

The competent probate court and current procedural stage must be identified. The correspondence already available must be collected, and an immediate assessment of protective measures must be sought if limitation is approaching.

Which claims survive the other skier’s death

The transfer of financial obligations to an heir is provided for by Section 548 ABGB, and liability for bodily injury caused before death therefore generally survives. Separate proof remains required for liability for the collision: the claim is established by the sequence of events, breach of duty, fault, and the connection between the collision and the injuries.

Treatment costs, lost earnings including future lost earnings, and appropriate compensation for pain and suffering are covered by Section 1325 ABGB. These claims are not expanded by the defendant's death. Any allocation of liability, an existing settlement and previous payments must still be taken into account when assessing the demand.

Estate or heirs: identifying the correct defendant

The estate continues the deceased's legal position as a legal person under section 546 ABGB upon death. Generally, the financial claim is directed against the estate before the court transfers the estate to the heirs. Austrian law designates this transfer as Einantwortung. Under section 547 ABGB, the heirs succeed to the estate's legal position at this stage.

The competent probate court, the case reference, and the current procedural stage are therefore required for preparing proceedings. Once the estate has been transferred, the transfer order, heirs, and inheritance shares must be examined. Avoidable procedural risks are created by suing a person who has already died. Whether an incorrect party designation can be corrected depends on the circumstances; preserving a claim should not depend on that possibility.

Representation while the estate proceedings remain open

An effective representative is required for the estate to enable service of proceedings and address the claim. Under section 810 ABGB, heirs who have sufficiently established their entitlement when accepting the inheritance may represent the estate unless the court orders otherwise. Where several people qualify, representation is generally joint unless they agree on a different arrangement.

Section 811 ABGB permits creditors to request the appointment of an estate curator where suitable representation is missing. Even prior to a declaration accepting the inheritance, creditors may seek payment or security from the estate. While the court commissioner conducts the estate proceedings, that role does not automatically render the commissioner the defendant or the representative for every damages action.

How acceptance of the inheritance affects recovery

Section 800 ABGB distinguishes between conditional and unconditional acceptance of an inheritance. Under section 801 ABGB, an heir becomes personally liable through unconditional acceptance, even if the estate cannot cover its debts. Conditional acceptance requires an inventory, and section 802 ABGB limits liability according to the estate's ability to cover the claims. This limit is not a general assurance that creditors can reach only particular inherited assets.

The form of acceptance also matters for several heirs. Joint and several liability is provided by Section 820 ABGB where heirs accepted unconditionally. Where an inventory was drawn up and the debt is divisible, inheritance shares are referred to by Section 821 ABGB. Practical recovery is affected by assets, other creditors, and possible breaches when paying creditors. Despite conditional acceptance, Section 815 ABGB can impose additional personal liability if creditors are disadvantaged by the defective payment process described there.

The deceased skier’s liability insurance

Whether the deceased was insured at the time of the collision and whether the incident falls within cover determine the insurance assessment. The policy, terms, insured limit, claim reference, and earlier statements are required. Section 149 VersVG links the insured's obligation to compensate to liability insurance. The later death alone resolves neither coverage nor the identity of the proper defendant.

Ordinary private liability insurance generally confers no statutory direct claim against the insurer upon the injured person. While the Austrian Supreme Court, in legal principle RS0080753, recognises that an insurer may undertake its own obligation to the injured person, such an undertaking must not be presumed. Close examination is required for any statement to that effect. Proceedings against the estate or heirs are not automatically replaced by insurance negotiations and a possible payment.

Registering the claim and preserving limitation separately

The deadline specified in the court notice must be observed if creditors are invited to register claims under section 813 ABGB. Under section 814 ABGB, late registration may leave no further claim against an estate exhausted by payment of registered claims, except to the extent that claims are secured by a pledge. Registration is distinct from bringing proceedings to preserve a limitation period.

For damages, three years from knowledge of the damage and the person who caused it are generally provided by section 1489 ABGB. That period is not automatically restarted by the defendant's death. Limitation is not safely interrupted by merely registering a claim or notifying a loss. Acknowledgement or bringing and duly pursuing proceedings are referred to in particular by section 1497 ABGB. If expiry is approaching, the defendant, representation and the specific protective measure must be promptly assessed by a lawyer.

Preparing serious injury and future loss claims

Different purposes are served by collision evidence and estate records. Liability is addressed by witness contacts, photographs, rescue records, and earlier statements by the deceased. The injuries and amount claimed are supported by medical reports, therapy records, income documents, and invoices. Additionally, the estate transfer order, inventory, and insurance documents identify who can be pursued and the financial scope of recovery.

A declaratory action under section 228 ZPO may be appropriate where further consequences remain possible and cannot yet be quantified. Obtaining a prompt declaration requires a legal interest. The medical prognosis and the correct defendant are essential. A settlement should identify the claims resolved and how possible future loss is treated; a broad waiver can substantially affect later enforcement.

Frequently asked questions

Death of the other skier and proceedings

Can I sue before the estate proceedings end? +
Claims against the estate can generally already be pursued; proceedings require the correct designation and effective representation, and an estate curator may be needed if representation is missing.
Are spouses or children automatically liable? +
Liability for the deceased's debt is not created by family ties alone. What matters are the status as an heir, the court transfer, and the form of inheritance acceptance; the particular liability must be established from the estate records.
Is notifying the liability insurer enough? +
Coverage and loss assessment are allowed by notification, and limitation against the correct debtor is not automatically preserved by it. Separate assessment is needed for any independent undertaking by the insurer and for an effective measure to preserve the time limit.
