After a ski accident there are often no neutral witnesses. Skiline, lift pass and turnstile data can help narrow down time, route and the last lift ride. They do not replace legal assessment, but they can make reconstruction far more precise.

Two legal layers meet here: damages and evidence under Austrian law, and privacy under the GDPR. Injured persons and accused participants should not rely only on screenshots. They should clarify what operator or access data exists and how it can be preserved.

Save app data immediately

Screenshots from Skiline or a similar app are a first indication. Preserve them unchanged with date, time and account reference. For proceedings, an operator request may still be needed because screenshots alone can be disputed.

Request operator data promptly

Turnstile and lift pass data are usually held by the operator or a service provider. A GDPR access request can help obtain personal data. For a damages claim, the key issue is whether the data supports time, location and direction of movement.

Use route data as part of the whole evidence picture

Lift pass data rarely proves the exact collision spot. It can show which lifts were used and whether a claimed presence is plausible in time. Together with witnesses, rescue report and photos it may form a stronger picture.

Privacy, access request and evidential value

Article 15 GDPR may be a starting point for obtaining personal lift pass or access data. It does not mean that every technical log must automatically be disclosed. The key question is whether the data relates to an identifiable person and remains retrievable for the accident day.

For liability, the evidential value is then assessed. A turnstile timestamp does not prove a collision, but it can support or contradict presence and route. Card number, account, accident day and approximate time should therefore be recorded immediately.

Distinction from helmet camera, GPS and rescue report

Helmet camera and GPS are your own recordings, while lift pass data comes from the operator system. The rescue report usually records assistance, location and injuries, not every previous lift ride.

The combination matters. If lift pass data, rescue report and witnesses fit together, the account becomes more plausible. If they conflict, timestamps, time zones, multi-day passes or use by another person must be clarified early.

Practical steps after the accident

Do not request data only months later. Technical or organisational retention may be short, without creating a general duty to store forever. A prompt and precise request improves the chance that data still exists.

Do not publish other persons data and avoid unsupported allegations against the other participant. A structured evidence list is safer: card data, witnesses, photos, rescue report, medical records and insurance documents.

Lift pass data is rarely the only evidence. It becomes stronger when it fits the rescue report, photos, witnesses and medical records.

It depends on who processes the data and whether it can be linked to a person. A GDPR access request may be useful if it precisely refers to accident day, card number and time period.

Does a turnstile timestamp prove how the accident happened? +

No. It does not prove the collision itself. It can show whether a person was in a certain area at a certain time and whether a claimed route is plausible.

May I send app screenshots to the insurer? +

Your own app data may be used as part of evidence preservation. Check first whether other persons or personal data of others are affected.

What if the operator does not reply? +

Document the request and timing, preserve other evidence and assess whether a further access request or a procedural application is useful.
